TERMS AND CONDITIONS

Please read this document carefully! It contains critical information about your rights and obligations, as well as limitations and exclusions that may apply to you if you register for this website. By registering, you acknowledge and agree to be bound by all of the terms and conditions stated herein. If you do not agree to these terms, do not register for the website. GIGABYTE reserves the right to modify or terminate the site and/or any of its interactive components at any time and in any manner, in whole or in part, as outlined below, even though such changes may affect the redemption value of the points already accumulated or the availability of redeemable merchandise. You agree that you will review these terms periodically and that you shall be bound by any modifications thereof.

  • 1. GIGABYTE AORUS Rewards Program
    • Participants in the GIGABYTE AORUS Member Rewards Program will have the opportunity to earn points, redeem rewards, receive exclusive promotional event notifications, enjoy additional benefits on their birthday, and receive the latest updates. This member rewards program is available in countries other than mainland China (excluding Hong Kong and Macau), and joining is free of charge.

  • 2. The Ways You Can Earn AORUS Points
    • 2.1. Product Registration
      • Within the valid purchase period, members can register specified products on the designated list, upload a complete invoice or valid proof of purchase, fill in the relevant information, and, upon successful verification, receive AORUS Points as a reward. The points will be automatically credited to your member account within two business days after the product registration is approved. If the invoice or proof of purchase you provide makes it difficult to identify the registered product, the review time may be extended, and the acquisition of AORUS Points may be delayed. Participation in the GIGABYTE AORUS Member Rewards Program allows AORUS Points obtained through product registration to be effective in only one account. The same product serial number (SN) can only be registered once and receive AORUS Points in one member account. If there are issues with an individual account that prevent product registration from being effective, GIGABYTE reserves the right to interpret the points rules.

        GIGABYTE reserves the right to interpret and explain the rules governing product registration, point acquisition, and point redemption, and has the authority to take action against member accounts that have obtained points illegally, including but not limited to unlawful or fraudulent activities, while also reserving the right to pursue legal action.

        If a product is subject to a return or exchange, GIGABYTE has the right to cancel the product registration information for the returned product, and AORUS Points for product registration will not be obtainable thereafter. Members must complete the product registration again for the newly exchanged product to earn AORUS Points. If a member has already redeemed rewards using AORUS Points obtained through product registration before returning the product, GIGABYTE reserves the right to retroactively deduct the AORUS Points obtained through product registration from the member's account after the product return.

        GIGABYTE staff members, including dealers, agents, studios, system integrators, and the like, are not eligible to participate in this program to avoid unfair disputes and abuse of privileges. If a product purchase and registration are intended for resale or wholesale purposes, AORUS Points cannot be obtained, and participation in point redemption is not possible. If you have any concerns, please contact customer service for assistance.

        The abnormal registration criteria for products are as follows:
        (1) Registering more than 30 products within one year.
        (2) Registering the same product model more than three times within one year.

    • 2.2. Participation in Activities
      • By participating in designated activities on the AORUS website, you have the opportunity to earn AORUS Points. You can earn AORUS Points through the following methods, but not limited to them: updating your personal account information, submitting articles or videos, engaging with the community, and participating in other designated activities on the website. The activities for earning AORUS Points may change periodically and without prior notice. Members can participate in activities multiple times but can only earn AORUS Points once from the same designated activity on the AORUS website.

    • 2.3. Invite Friends
      • By using your personal code to invite friends to register as GIGABYTE AORUS members, you can earn AORUS Points as a reward. You must set your personal invitation code in the Account Details. Each member has only one opportunity to change the personal invitation code for their member account.

        Whenever a friend successfully registers as a member using your personal invitation code, you will earn 5 points. In the GIGABYTE AORUS Member Rewards Program, the maximum monthly limit for points earned through this method is 100 points (equivalent to 20 friends successfully invited and registered). Each member account can earn a maximum of 250 points (equivalent to 50 friends successfully invited). Your personal invitation code can only be shared with the same friend or the same email address once. GIGABYTE reserves the final decision-making authority on earning AORUS Points through invitation codes.

  • 3. Explanation of 'Redemption Points' and How You Can Use Them to Redeem Rewards
    • The list of redeemable rewards will be posted on the AORUS website and will be periodically updated on the "AORUS Points & Rewards" webpage. GIGABYTE reserves the right to adjust the reward items, including the required "Redemption Points" and available reward items, which may vary by region. However, we encourage you to check the webpage for the latest reward items at any time. In the event that the original redeemable reward item is out of stock or unavailable for any other reason, GIGABYTE reserves the right to substitute it with an equivalent or higher-value reward item. The specific "Redemption Points" required for each reward item will be detailed on the "AORUS Points & Rewards" webpage. You cannot request to use existing "Redemption Points" to redeem rewards unless you have accumulated a sufficient amount in your member account.

      The process for redeeming rewards is as follows:
      (1) Visit the "AORUS Points & Rewards" webpage.
      (2) Select the reward you wish to redeem and follow the instructions to confirm the redemption of your chosen reward.
      (3) After confirming and submitting the redemption request, the required "Redemption Points" will be deducted from your member account.
      (4) Upon confirmation of your application, you will receive a redemption notification email in your registered mailbox.
      (5) Once the redemption request has been approved, it cannot be canceled, and the "Redemption Points" cannot be refunded to your original member account.

      The images of rewards on the website or posts are for reference purposes only. The actual reward products may vary from the images displayed on the website or posts. Redemption activities are applicable only to the end consumers and must be claimed by the account holder. Proxy claims are not allowed. In case of any fraudulent activity, GIGABYTE reserves the right to take action against the member account and may pursue legal action if necessary.

      You are not responsible for any shipping or delivery costs. The shipping location will be based on the shipping address provided in your member account or the address confirmed during the redemption process. Redeemed rewards will be shipped within 2 to 4 weeks after the redemption application is confirmed. GIGABYTE is not responsible for failed deliveries due to incomplete, unidentifiable, or incorrect information provided by you.

      GIGABYTE reserves the right to cancel items on the rewards list at any time. In case of any errors in indicating the required "Redemption Points" in any activity, post, or information (including but not limited to hardware, software, and/or human errors), GIGABYTE reserves the right to correct such errors and may not provide the redemption rewards accordingly.

  • 4. Member Account, AORUS Points, and Product Invoice/Purchase Receipt Verification Restrictions
    • 4.1. Member Account
      • Each member is allowed to register only one member account using a single email address and cannot register repeatedly. If GIGABYTE discovers any instances of duplicate account registrations, it reserves the right to suspend or terminate the member's account without prior notice, and all member accounts and AORUS Points associated with them will be considered invalid.

        Once you have completed the member registration process, you will receive a specific password and member account. You are responsible for managing and keeping your account, password, and other member information confidential. You are not allowed to lend, transfer, or disclose your password or account to third parties. Any input of member account and password in accordance with the prescribed method, regardless of whether it was personally entered by you, will be deemed as your own use. You are fully responsible for all actions performed using that password and account.

        To ensure the proper use of member-related services and procedures, you agree to the following terms:
        (1) If you provide any incorrect or false information, fail to provide information as instructed, lack necessary information, or engage in duplicate account registrations, GIGABYTE reserves the right to suspend or terminate your account without prior notice and may cease providing you with some or all of the member services.
        (2) If a member account is terminated by you or GIGABYTE for any reason, all accumulated AORUS Points associated with that account will be cleared.
        (3) GIGABYTE reserves the right to review the validity of purchase receipts uploaded to member accounts.
        (4) AORUS Points in a member account cannot be transferred or shared with any other member account.
        (5) Any third-party entities, organizations, schools, institutions, or groups, other than natural persons, are not allowed to register member accounts or participate in the GIGABYTE AORUS Rewards Program.

      • 4.1.1. Account Registration Disputes
        • After registering for a GIGABYTE AORUS member account, members can view their registration information and AORUS Point balances in their accounts. GIGABYTE will make every effort to update AORUS Point statuses promptly, but it is not responsible for any unauthorized or misleading points. If AORUS Points are credited in an improper manner, obtained by fraudulent means, or acquired in ways not described here, GIGABYTE reserves the right to invalidate the AORUS Points. GIGABYTE is not liable for discrepancies, omissions, inconsistencies, or errors in member account information. GIGABYTE reserves the right to revoke unused AORUS Points or modify their expiration dates. Regarding AORUS Point balances, redemption, confiscation, and access to member accounts, GIGABYTE's decisions are final and binding.

          If there is a dispute regarding the identity of the account holder, the account registration will be deemed to have been made by the authorized account holder of the email address used for registration, and the "authorized account holder" must comply with these terms and conditions. The "authorized account holder" is defined as the natural person who is granted access to an email service via the internet, or an email account provided by a specific domain for the purpose of registering and becoming a member.

    • 4.2. AORUS Points
      • 4.2.1. Validity of AORUS Points
        • AORUS Points should be retained within the member's account until they are either reset to zero or redeemed, whichever occurs first. GIGABYTE will not consider adjustments to the account as qualifying activities. Expired AORUS Points will be removed and reset to zero from the member's account. Expired AORUS Points are not eligible for extension, cash refunds, or any other form of exchange.

      • 4.2.2. AORUS Points Restrictions
        • GIGABYTE reserves the right to limit or change the maximum number of invoices/purchase receipts that can be uploaded daily, or modify any existing invoice/upload limits, without prior notice. You should stay informed about the provisions of this agreement. If you do not agree with the modified terms, you may stop using this service. Continued use of this service will be considered as your acceptance of the modified terms.

      • 4.2.3. AORUS Point Value
        • AORUS Points are not personal property, do not confer vested rights or benefits to members, and have no cash value. Unused AORUS Points will be deemed invalid upon termination of the rewards program or upon expiration of the validity period as specified by GIGABYTE. Unused AORUS Points may also become void due to illegal or illegitimate acquisition. GIGABYTE reserves the right to modify or dispose of unused AORUS Points.

      • 4.2.4. Transfer Prohibited
        • Product invoices/purchase receipts, AORUS Points, and member accounts may not be sold, traded, exchanged, transferred, or shared with third parties, either through online auction websites or other means. GIGABYTE reserves the right to determine and revoke or cancel any AORUS Points that have been sold, traded, exchanged, transferred, or shared. AORUS Points redeemed cannot be refunded, transferred, or reused.

    • 4.3. Product Invoice/Purchase Receipt Verification Limitations
      • Each product invoice/purchase receipt can only be verified once. If a previously verified product invoice/purchase receipt is uploaded again in the future, it will be considered invalid, and you will not be eligible to receive AORUS Points. All product invoices/purchase receipts must be uploaded within 30 days of the purchase date to qualify for AORUS Points. The data uploaded from product invoices/purchase receipts will be retained by GIGABYTE for up to one year.

      • 4.3.1. Verification of Product Invoices/Purchase Receipts
        • All verifications of uploaded invoices/purchase receipts are at the sole discretion of GIGABYTE. Invoices/purchase receipts that are deemed invalid for any reason will not be eligible for any AORUS Points. GIGABYTE reserves the right to determine the invalidity of an invoice/purchase receipt for any reason, including but not limited to the following circumstances:

          • The invoice/purchase receipt is obtained from unauthorized or illegal sources, including but not limited to online purchases or sources not obtained through legitimate means, or obtained from physical auctions.

          • The invoice/purchase receipt is not original, difficult to authenticate, tampered with, damaged, altered, duplicated, stolen, forged, or does not comply with specifications or is improperly labeled.

          • The invoice/purchase receipt has not been verified or confirmed as valid by the merchant or retailer.

          • It is determined that the invoice/purchase receipt has been previously uploaded and used.

          • The upload or submission of the invoice/purchase receipt is incorrect or incomplete.

          • The invoice/purchase receipt contains printing or manufacturing errors or any form of inaccuracies.

          Except as expressly provided above, GIGABYTE shall have no responsibility or obligation with respect to any invalid invoices/purchase receipts. Only invoices/purchase receipts obtained through methods approved by GIGABYTE are eligible for participation in the rewards program. Invoices/purchase receipts collected through secondary recycling centers, printing devices, or institutions (including, but not limited to, hospitals or schools) do not qualify.

  • 5. GIGABYTE Reserves the Right to Modify the Terms and Conditions
    • GIGABYTE reserves the right to modify, update, and terminate the terms at any time.

      Such modifications, updates, and terminations may include, but are not limited to, changes in the duration of GIGABYTE AORUS Rewards Program activities, methods of earning points, types of games, sweepstakes or other promotional activities, the quantity and content of point redemption, and your membership account.

      These modifications, updates, and terminations can be made at any time and may affect your rights to earn or use points, with no prior notice.

      You are considered to have agreed to the modifications, updates, and terminations of these terms and consented to be bound by any revised versions of the terms. It is recommended that you regularly review the current terms to ensure your membership rights.

      Any violations of these terms, fraudulent reward activities, violations of local laws, deceptive actions against GIGABYTE, or any actions that harm GIGABYTE give GIGABYTE the right to terminate your membership account services and seek legal remedies against you, including but not limited to litigation costs and attorney's fees. Your account and ownership of all accumulated AORUS Points in the GIGABYTE AORUS Rewards Program will be determined by GIGABYTE or its authorized agents.

  • 6. Disclaimer and Limitation of Liability
    • GIGABYTE shall not be liable or responsible for any technical issues or technical failures that may affect or disrupt the operation of the Rewards Program, including but not limited to hardware or software errors, computer malfunctions, phone, line, satellite, network, electronic equipment, network equipment, network congestion, internet, or other online communication problems; errors or limitations of any internet service provider, service equipment, host, or phone provider; data transmission with errors, confusion, or mistakes; undelivered, delayed, lost, corrupted, or damaged electronic mail or messages; inability to use the website in whole or in part for any reason; unauthorized personnel or non-human intervention in the operation of the Rewards Program, including but not limited to human errors, unauthorized alterations, hacker attacks, fraud, theft, viruses, vulnerabilities, or destruction of any data or information related to the Rewards Program. Losses related to member accounts in connection with the GIGABYTE AORUS Rewards Program include but are not limited to unauthorized alterations by unauthorized personnel, system intrusions by hackers leading to loss, deletion, miscalculation, or other abnormal operation of account content.

      GIGABYTE shall not be responsible for any personal injury, property damage, or loss suffered by users or others as a result of participating in the GIGABYTE AORUS Rewards Program, using, or downloading any information from this website. The user assumes all risks associated with the use of this website. Without limiting the foregoing, all content in the Rewards Program is provided 'as is' without any express or implied warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Some countries or regions may not allow limitations of liability, so the above limitations may not apply to you.

  • 7. Terms and Conditions Priority
    • In the event of a conflict between this Terms & Conditions and the details and circumstances contained in other terms, the rules specified within this Terms & Conditions for the GIGABYTE AORUS Rewards Program shall prevail.

      If any provision or part of this Terms & Conditions is deemed invalid or unenforceable by a court with jurisdiction in that country or region, that provision shall be separated from the rest of this Terms & Conditions, and the remaining terms and conditions shall remain fully effective.

  • 8. Personal Privacy
    • When you complete the registration for GIGABYTE AORUS membership, it signifies that you are exercising your legal rights by electronic means. You consent to GIGABYTE collecting, processing, and utilizing your personal information. If you do not agree, please exit the registration page. The personal information collected from your membership account by GIGABYTE is subject only to the privacy policy governing the management of the GIGABYTE AORUS Rewards Program. Unless you choose to receive additional promotional messages from third-party partners, GIGABYTE will not share your registered personal information with any third parties. You agree to GIGABYTE utilizing the relevant data from your purchase of registered GIGABYTE AORUS brand products, which will enable GIGABYTE to provide you with more promotional offers and activities.

  • 9. Dispute Resolution
    • You agree that any claims shall be brought against GIGABYTE in an arbitration on an individual basis only and not as a plaintiff or class member in a purported class or representative action. You further agree to waive any right for such claims to be brought, heard, or arbitrated as a class, collective, representative, or private attorney general action, to the extent permissible by applicable law. Combining or consolidating individual arbitrations into a single arbitration is not permitted without the consent of GIGABYTE.
